Terms of Service

Welcome to Talkable. These Terms of Service govern your access to and use of our platform. By registering for an account or integrating our services, you agree to be bound by these provisions. Please read them carefully to understand your rights and obligations.

1. Acceptance of Terms

By utilizing the Talkable infrastructure, you represent that you are of legal age to form a binding contract and possess the authority to commit your organization to these terms. If you do not agree with any part of this agreement, you must immediately cease using our services and platform.

2. Platform Provision & Evolution

Talkable delivers a sophisticated Software-as-a-Service (SaaS) environment for deploying AI-driven conversational agents. This includes knowledge base processing, lead aggregation, and conversational analytics. We continuously innovate; therefore, we reserve the right to upgrade, modify, or deprecate features to optimize performance, providing reasonable notice for material changes.

3. Subscriptions & Billing Architecture

Account security is your responsibility. Talkable operates on a transparent, recurring subscription model (Starter, Pro, Business). Subscriptions are billed proactively and are non-refundable except where mandated by local consumer law. You maintain complete control over your subscription status and may initiate cancellation at any time via your dashboard, with access persisting until the current cycle concludes.

4. Acceptable Use Policy

Talkable is engineered to facilitate genuine business growth. You strictly agree not to deploy our infrastructure for spam generation, malicious social engineering, impersonation, or any activity that violates applicable regulatory frameworks. Reverse-engineering our APIs or intentionally overwhelming our systems is prohibited and will result in immediate service termination.

5. Data Ownership & Content Licensing

You retain absolute ownership of the proprietary data, prompts, and branding assets you upload. By ingesting your data into Talkable, you grant us a secure, strictly scoped, non-exclusive license to process this information solely for the purpose of operating your custom AI assistant. You remain legally responsible for ensuring your data does not infringe on third-party intellectual property.

6. Intellectual Property Rights

The core Talkable engine, proprietary algorithms, UI/UX design, and brand assets are the exclusive intellectual property of Talkable. Accessing our platform does not grant you licensing rights to our underlying codebase or trademarks beyond what is necessary to utilize the SaaS product as intended.

7. AI Infrastructure Partners

To deliver enterprise-grade intelligence, Talkable routes queries through tier-1 LLM providers (including OpenAI, Anthropic, and Google). You understand that AI output is probabilistic. Talkable does not manually verify conversational output and is not liable for hallucinations, inaccuracies, or business friction caused by the algorithmic responses generated by these third-party engines.

8. Warranty Disclaimer

TALKABLE IS DELIVERED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPLICITLY DISCLAIM ALL WARRANTIES, WHETHER STATUTORY, EXPRESS, OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, OPERATIONAL CONTINUITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE AI RESPONSES WILL BE FLAWLESS OR THAT UPTIME WILL BE UNINTERRUPTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY JURISDICTIONAL LAW, TALKABLE SHALL NOT BE HELD LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES-INCLUDING LOSS OF REVENUE, DATA CORRUPTION, OR REPUTATIONAL HARM-ARISING FROM PLATFORM USAGE. OUR MAXIMUM CUMULATIVE LIABILITY WILL NEVER EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Governing Law & Dispute Resolution

These terms shall be interpreted and governed by applicable commercial law. In the event of a dispute, both parties agree to attempt good-faith resolution before escalating to formal arbitration or the courts of competent jurisdiction associated with Talkable's corporate registration.

11. Agreement Modifications

As the regulatory landscape for AI shifts, we may update these terms. Material updates will be communicated via your registered email or a prominent dashboard notification. Continued utilization of your AI assistants following these updates constitutes legal acceptance of the revised terms.
